01 Acceptance of Terms
By accessing or using Malakai AI, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use our services. These terms constitute a legally binding agreement between you and Malakai AI regarding your use of our digital curation platform and voice intelligence services.
We reserve the right to modify these terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this document.
02 Acceptable Use and Restrictions
You are strictly prohibited from using Malakai AI for any of the following activities:

Cloning the voice of any individual without their express, written, and verifiable consent.

Emergency Services
Attempting to contact, simulate, or interfere with 911 or other emergency response systems.

Unsolicited Telemarketing
Using our AI for robocalling, automated sales pitches, or any form of unsolicited commercial communication.

Fraud and Deception
Impersonating financial institutions, government agencies, or creating deepfake content for fraudulent purposes.

Sensitive Information
Processing or soliciting protected health information (PHI), payment card data (PCI), or government IDs through voice interactions.
03 Compliance
Global Telecommunications
Users must strictly comply with all applicable telecommunications laws, including but not limited to:
TCPA
The Telephone Consumer Protection Act and subsequent FCC rulings regarding AI-generated voice.
PECR
Privacy and Electronic Communications Regulations for users operating within the UK or EU.
You are solely responsible for providing necessary call recording disclosures as required by "All-Party Consent" states and international jurisdictions.
04 Intellectual Property
The Malakai AI platform, including its software, voice models, brand assets, and curated algorithms, is the exclusive property of Malakai AI. We grant you a limited, non-transferable license to use the service for its intended purpose. You retain ownership of your original input data, but grant Malakai AI the right to process this data to provide and improve the services.
05 Termination
We reserve the right to suspend or terminate your access to the service immediately and without notice if we determine, in our sole discretion, that you have violated these terms or used the service in a manner that poses a risk to Malakai AI or any third party.
06 Limitation of Liability
MALAKAI AI IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LEGAL FINES RESULTING FROM YOUR BREACH OF TELECOMMUNICATIONS LAWS.
